Frequently Asked Questions about Personal Injury in Howell, NJ
Although it may seem like you cannot file a personal injury lawsuit if you signed a waiver releasing the other party from liability, in many cases it is still possible to file a claim for negligence. In many cases, a waiver is found by the court to be unenforceable. Even where a waiver may be enforceable, they are intended to inform you of possible harms and obtain your acknowledgement that harm may occur; however, they are not intended to serve as a loophole if the other party commits an act of negligence.
You may have a personal injury claim if you have suffered an injury that has caused you to incur compensable losses, and that injury was caused by someone else’s intentional or willful acts, recklessness (a conscious disregard for a substantial risk of injury), or negligence (a failure to comply with a duty of care).
