$781,000 Settlement for Slip & Fall Injuries

A complex premises liability case was settled by Blume Goldfaden lawyer Mitchell Makowicz for $781,000. The accident occurred outside the Big & Tall Store located in an East Brunswick strip mall. Ice that had formed under the awning began dripping onto the sidewalk as the weather turned warmer. The slanted awning had no drains or gutters to direct the water away from the common areas, where Mr. Makowicz’s client slipped and fell. He suffered a fracture of the distal femur, the bone between the hip and knee. He has had six surgeries, including an open reduction with internal fixation.

Mr. Makowicz maintained that the Big & Tall Store had an obligation to take proper care of the sidewalk in front of the store. He also filed suit against the strip mall owners.
