The firm represented a middle-aged woman who slipped and fell on snow in a parking lot of her place of employment at 6:00 o’clock in the morning. The governor had declared a “state of emergency” for a large snowstorm that fell the night before our client’s accident. The firm demonstrated, through multiple depositions, that the landscaping company did not provide the full amount of trucks necessary to clear the snow by the time the employees were expected to come to work, as was required by the mutual understanding of the parties, even though the contract between the landlord and landscaper was silent as to this specific issue.
