$250,000 Settlement – Bicycle / Truck Accident

John E. Molinari represented a 47 year old off-duty police officer who was struck by a truck driver that was delivering mail for the United States Postal Service. Plaintiff was riding his bicycle at the time and was training for an upcoming charity bicycle ride. Plaintiff’s most serious injury was a fracture at the base of his neck that fortunately was able to go on to heal without the need for cervical intervention. Plaintiff also later claimed injuries to his hip that the defendant claimed were pre-existing. Both sides had expert witnesses to support their claims and the depositions of both doctors had been completed. The case was awaiting a trial date in Federal Court that had been stayed during the pandemic but was settled after multiple conferences with the United States Magistrate.
