John E. Molinari represented a 15 year old boy who was shot in the left eye while in a friend’s backyard by a BB gun they had jointly purchased at a store. The son of the homeowner was the shooter. The homeowners were inside the house and allowed a group of teenagers to shoot at one another with the BB guns. The injury resulted in permanent loss of vision to the boy’s left eye. The allegations made against the store and its employees were that they failed to verify the plaintiff’s age and sold the BB guns to minors.

All parties agreed to proceed to mediation which resulted in a total settlement amount of $1,100,000.00. The defendant homeowner’s insurance carrier paid $450,000.00 and the store paid the other $650,000.00.
