$1,450,000.00 Recovery — Missed Stroke Diagnosis

Blume Forte partner Michael B. Zerres recently obtained an out of court settlement on behalf of a Union County woman whose stroke diagnosis was delayed.

The client presented to the emergency room with visual changes in her left eye, but a test for a visual field defect was performed incompletely leading to her inappropriate early discharge. Two days later she returned to the same emergency department with worsening symptoms on the left side. Testing revealed that a right sided stroke had occurred, but the opportunity for limiting the harm from her stroke was missed two days earlier when she was seen and released, instead of being admitted for additional testing and treatment.

As a result of the delayed diagnosis, the client was left with moderate residual motor deficits on the affected side of her body.
