Newark Construction Company Fails to Provide Fall Protection for Employees

A Newark-based construction company, Discovery Construction Corp., is facing proposed fines in the amount to $58,080, after receiving citations from the U.S. Department of Labor’s Occupational Safety and Health Administration (OSHA) for violating fall protection standards. According to the OSHA regional news release, the agency conducted an inspection in conjunction with its program on fall hazards in construction. After inspecting a construction site in Monroe, New Jersey, OSHA issued three repeat citations to Discovery Construction Corp. totaling $48,840 in penalties, and two serious citations with $9,240 in penalties. The news release attributes the repeat citations to the construction company’s failure to: provide fall protection to employees working on roofs about 11 feet above ground level, lengthen two ladders 3 feet above the work vicinity, and shield employees from eye injuries while using pneumatic nail guns. The “serious” citations were issued due to the construction company’s failure to: perform frequent and standard inspections of the jobsite, and, due to deficiencies pertaining to the use of a ladder in accessing a roof.

The U.S. Department of Labor considers falls as one of the primary causes of traumatic occupational death; accounting for eight percent of all work-related fatalities.
