Confidential Settlement for Product Liability / Crush Injuries

The firm represented a middle-aged man whose hand sustained serious crush injuries when a towel he was using to clean a machine at work became stuck in a “nip and pinch point,” pulling his hand into the pinch point in a machine that was over 50 years old. The machine had numerous nip and pinch points that were not guarded. The firm sued the product manufacturer and employer, as a number of other employees had sustained similar types of injuries in the past, and the employer failed to adequately guard the nip and pinch points of the machine despite prior notice of this hazard. The firm resolved the case for a significant but confidential sum with the machine manufacturer from Germany; he was also successful in greatly compromising the workers’ compensation lien, netting the client an additional significant but confidential sum.
