$916,000 Settlement for Unsafe Workplace / Wrongful Death

Kenneth Elwood represented the estate and family of a 43-year-old man who was killed in an industrial accident at his place of work, the defendant concrete recycling plant located in New Jersey. The man was performing maintenance work on a piece of equipment that was being dismantled inside of the plant. The accident occurred when he was struck by a piece of equipment that was being lifted by a crane causing him to be trapped between the components of the large piece of equipment. Thirty-three (33) days before the accident the computer which controls the operations of the crane known as a Load Moment Indicator (LMI) had been removed by another defendant company working on the crane equipment. The crane was supposed to be removed from service until it was repaired, but it remained in operation. The matter resolved at mediation on September 27, 2010, just prior to its scheduled trial date of October 4, 2010. The decedent left behind a surviving spouse and a thirteen year-old daughter.
