$266,000 Settlement for Slip and Fall

The plaintiff, a 77-year-old woman, was in a boutique store shopping for gifts with her husband at a casino in Atlantic City. Her attention was drawn to a handbag, high on a shelf on the far wall of the store. As she made her way towards the handbag, she fell due to the manner in which display racks had been arranged and the manner in which the protruding base of one of the racks had been obscured by merchandise. The resulting fall caused a serious fracture of her right shoulder, requiring an extensive shoulder replacement surgery and long-term rehabilitation therapy. Despite claims that the plaintiff had herself been negligent in failing to watch where she was walking, a judgment following arbitration in the amount of $266,000 was obtained.
