$250,000 Settlement for Failure to Timely Diagnose Cancer

The firm represented a man who was diagnosed with a gastrointestinal stromal tumor, or GIST, after it had grown so large that it ruptured in his stomach. More than a year before that incident, however, two separate radiologists read CT scans of his abdomen and missed what was clearly the same tumor but in an earlier stage.

Fortunately for the firm’s client aggressive medical treatment with surgery and drugs has prevented any spread of the disease, but he did experience significant pain, suffering and emotional distress as a result of the delayed diagnosis. The case settled prior to trial for $250,000.
