$1,420,000 Recovery for Failure to Follow Up on Doctor’s Instructions

Blume Donnelly Principle, Michael B. Zerres, represented a 58 year old developmentally delayed man who was a resident at a group home operated by The ARC of Middlesex County. The man fell in the shower and hit his head. His doctor ordered a CT scan of his head. However, the ARC employees never carried out that order to ensure that the man received the timely care he needed. Subsequently, the man was diagnosed with a subdural hematoma (brain bleed) requiring surgery. The delay in testing and treatment , and his injuries suffered because of those delays, resulted in our client requiring closer monitoring, permanent residency in a nursing home, and, he was not able to return to living in a group home setting.
