$650,000 Settlement for Failure to Diagnose Breast Cancer

A 56-year-old woman obtained a $650,000.00 recovery when two radiologists who reviewed her screening mammography films failed to identify and report the presence of new calcifications. One year later, another radiologist reviewed her screening mammography films and detected the presence of many more calcifications, resulting in a diagnosis of breast cancer. By this time, the cancer had spread to lymph nodes and even had left 2 deposits on the spine. Surgery and adjuvant therapy was required. Fortunately, with the approval of a new medication for this patient’s type of disease, the client has had no recurrence of her cancer and the metastatic deposits on the spine have resolved. The defense argued that had the patient’s cancer been diagnosed a year earlier she would have required the same treatment, and, would have had the same outcome and prognosis.
