$675,000 & $630,000 Settlements for Erb’s Palsy

Blume Donnelly principal Michael Zerres recently settled two medical malpractice cases involving Erb’s Palsy injuries to newborn infants, which occurred when their mother’s obstetricians failed to properly manage a shoulder dystocia presentation at delivery. The cases settled for $630,000 and $675,000, respectively. In both matters, the infant plaintiffs sustained a tearing injury to the brachial plexus nerves at the C5-C6 levels requiring surgical repair. Despite operative intervention, the children were left with a moderate degree of residual impairment resulting in limited range of motion and use of the effected shoulder, upper arm, forearm and hand.
