Confidential Settlement for Inadequate Security

John Molinari represented a Jersey City police officer who responded to a 911 call at a pharmacy location, where he was shot and killed in the parking lot by an assailant using the gun that he had taken from the store’s security guard. Suit was filed against the pharmacy and the security company for claims of negligent security. Plaintiff’s proofs established that the pharmacy did not follow the correct protocol for an active shooter being in the store and failed to alert the JCPD that the assailant had left the store and was waiting to ambush the responding police officer. Video from the store’s security camera showed the security guard not following procedures just before being overpowered by the assailant. The case settled just before trial for a confidential amount.
