John E. Molinari represented a 37 year old project manager who was returning from a job site when he was struck in the rear by a dump truck on Route 280 in Newark, New Jersey. As a result of being struck by the truck, plaintiff struck the rear of the vehicle that was in front of him. The passenger in that vehicle was also injured and both cases were consolidated for litigation purposes.

As a result of the negligence of the dump truck driver, plaintiff suffered a torn medial and lateral meniscus in his right knee and after a brief period of conservative treatment, underwent an arthroscopy of his knee approximately 18 months post-crash. Plaintiff also suffered a posterior labral tear and underwent an arthroscopy of his right shoulder almost 2 years post-crash. He also suffered disc herniations in his low back and neck that required a brief period of pain management as well as complaining that he suffered from some limited cognitive deficits though he did not undergo any treatment for the alleged deficits. Plaintiff claimed to have been out of work for an extended period of time following the incident though he was unable to produce some of the documentation to substantiate that claim.

The matter was arbitrated, and had multiple settlement conferences before settling just prior to the third trial date for $300,000.
