$1,000,000 Settlement Obtained for New Jersey Wrongful Birth Case

By birthinjury on March 30, 2012

Blume Forte partner, Carol L. Forte, obtained a $1,000,000 settlement on behalf of a child who was born with severe heart abnormalities. As a result, the child has had to undergo multiple surgeries and extensive medical treatment; and, the child will continue to suffer from lifelong medical conditions.

In this case, Ms. Forte established that the obstetrician failed to determine that her client’s medical history included a maternal congenital heart defect, which, had it been known, would have qualified the necessity for a fetal echocardiogram during the prenatal period. If an echocardiogram were performed, it would have shown that the fetus had several severe heart defects. With this knowledge, the parents would have been given the opportunity to manage the pregnancy as they deemed appropriate.

Medical malpractice can include multiple departures from the standards of care, including a failure to ascertain a proper history or recognize the significance of information provided. Identifying whether a person has a history of a serious medical condition may be essential to providing that person with the proper care. Overlooking medical history can result in improper or contraindicated care.
