$1,930,000 Settlement Obtained for Cerebral Palsy Fetal Distress

By birthinjury on January 25, 2012

Carol L. Forte of the New Jersey Personal Injury Law Firm of Blume Forte obtained a $1,930,000 settlement in a New Jersey cerebral palsy birth injury case.

It was proven that the obstetrician failed to recognize that the fetal monitoring strips were displaying signs of fetal distress and that the baby was being deprived of adequate oxygen during the mother’s labor. Additionally, the obstetrician failed to perform a cesarean section delivery of the child, therefore contributing to an ongoing limited oxygen supply to the baby’s brain during labor. As a consequence, the baby suffered serious brain damage, which manifests as Cerebral Palsy.

There is no cure for Cerebral Palsy, which is defined by various neurological disorders affecting body movement and muscle coordination/strength. The disorder is caused by abnormalities in sections of the brain that control muscle movement and these abnormalities can be caused by oxygen deprivation during the birth/labor processes.

Birth injuries can result from medical malpractice in which a medical professional’s careless and negligent acts and/or omissions can cause a baby and/or the mother to suffer serious injury, illness, or death. It is the responsibility of medical professionals to properly monitor both the mother and fetus during the labor and delivery; and to render appropriate treatment in a timely manner to prevent injury to either patient.
