$1.85 Million Settlement for Failure to Timely Diagnose Breast Cancer

Blume Donnelly principal Carol Forte represented a young woman who complained to her gynecologist of a lump in her breast and was sent for an ultrasound. The ultrasound was misread – the radiologist failed to appreciate a mass, calling it instead an undefined “tubular structure.” The gynecologist told the patient that the ultrasound was negative and probably what she was feeling was a dilated duct from breast feeding. No follow up was ever ordered and when the cancer was discovered 17 months later it had already metastasized, i.e., spread, to her bones. The matter settled against both the radiologist and gynecologist for a total of $1.85 million dollars.
