$500,000 Settlement for Failure to Timely Diagnose Fetal Hypoxia

Carol Forte represented the family of a fetus which died at or near birth while under watch of nurse and doctor. Neither the doctor or nurse could explain why they did not appreciate the abnormal fetal monitoring strips which indicated that the fetus was suffering from a lack of oxygen. Both expected that the baby would be born healthy. In fact, the baby died either in utero immediately before birth or at birth. There were no abnormalities found at autopsy other than the effects of a lack of oxygen.
