The Star Ledger reports that New Jersey police have issued 225,000 citations for cell phone violations statewide. That number accounts for almost 4 percent of all moving violations in New Jersey. On November 2, 2007, the Governor had amended NJSA 39:4-97 to make hand-held cell phone use while driving a primary offense. That amendment gave officers the right to pull over drivers for using their cell phone while driving. It is now also a primary offense to text while driving. Before this amendment, authorities could only charge a driver with cell phone use while driving if they were in the act of pulling over the driver for some other violation.

Distracted driving is a serious hazard. “Cell phone use” related motor vehicle accidents are on the rise. Since 2008, 3,610 crashes, and, 13 deaths in New Jersey have been attributed to cell-phone related distracted driving. The Virginia Tech Transportation Institute (VTTI) reported that a driver’s chances of causing an accident increases by more than 23 times while texting (VTTI report).

There is no question that driving while talking or texting on a handheld cell phone or blackberry device is negligent driving. If you have sustained serious personal injuries in a New Jersey auto accident caused by a distracted driver, contact the experienced NJ auto accident lawyers at Blume Goldfaden for a no-cost consultation. You may be able to seek compensation to cover your medical expenses, physical injuries and lost income. Call us at 973-635-5400 to discuss your potential claim.

The Jersey Journal reported that a Jersey City worker was seriously injured in a construction site accident after he fell from a scaffold. The 31-year-old man was walking on scaffolding at a job site when a board, of which the scaffolding was constructed, gave way, causing him to fall. The victim displayed signs of having suffered back injuries from the fall. Witnesses said the man fell about 16 feet.

According to the Occupational Safety and Health Administration (OSHA), studies show that 25 percent of workers injured in scaffolding accidents in the United States have not received the proper safety training. OSHA studies have also found that 77 percent of scaffolds were not equipped with guardrails in order to prevent falls. OSHA also estimates that if safety standards were followed, as many as 50 lives could be saved each year, and, 4,500 accidents could be prevented.

The most common dangers associated with scaffolding include falls from elevation, scaffold collapse, being struck by falling or flying objects, and, electrocution due to proximity of power lines to the scaffold.

If you are a construction worker in New Jersey who has been injured by someone else’s carelessness or negligence, you may be able to hold the responsible parties liable for the resulting harm. An injured construction worker and/or their loved ones can seek compensation for medical expenses, loss of wages, physical pain and suffering, permanent disability, or, wrongful death. Even if you are collecting workers’ compensation payments, you may still be able to commence a 3rd party action against a subcontractor, or, the provider of faulty equipment responsible for your accident.

If you have questions with regard to your potential New Jersey construction accident case, call the experienced NJ construction accident injury lawyers at Blume Goldfaden for a no-cost consultation. Call us at 973-635-5400, and, we will evaluate your potential case to determine if there are any viable claims which can be made.

Honda has issued a vehicle defect recall for about 646,000 of its 2007 and 2008 Fit, Jazz, and, City models due to a defective power window switch that could cause the car to catch fire. According to a CNN news report, the recall was issued after one person in South Africa died in a car fire caused by the defective switch. Honda officials say extreme amounts of liquid, such as water from heavy rain, can flood the master power window switch on the driver’s side, causing it to overheat, and, potentially ignite.

The recall affects about 141,000 Honda Fit models in the United States where seven incidents of overheating, and two car fires were reported. However, there have been no reports of injuries or fatalities so far in the United States. If you own one of these affected models, you should receive a recall notice in the mail with instructions on how to have your vehicle inspected, repaired and/or fitted with a new switch at an authorized Honda dealership. Honda is proposing retrofits of some vehicles with a watertight skirt, and, replacing the switches in others.

Victims harmed by vehicle defects have the legal right to hold an auto maker liable for their injuries under New Jersey’s Product Liability Act. Honda’s is a serious auto product defect, which has the potential to cause catastrophic injury, or, even death.

If you have been seriously hurt in an accident caused by a defective vehicle, or auto part, contact Blume Goldfaden to discuss your potential case and your legal rights with a skilled New Jersey auto product defect lawyer. Our New Jersey Personal Injury Law Firm has a successful track record of having obtained numerous significant auto product liability case settlements and verdicts.

Recent data released by the New Jersey State Police indicates that New Jersey pedestrian accident fatalities in 2009 exceeded those in 2008. According to a news report, as of December 2009, 155 people died in pedestrian accidents in 2009 — up from 136 in 2008.

The State Police offer several useful safety tips for pedestrians. Pedestrians should stay off of highways where vehicle speeds are usually higher, and, where visibility is reduced for both drivers and pedestrians. If your vehicle is disabled, stay inside and call/wait for emergency assistance. Only cross roadways at legal crossings such as marked crosswalks. Never wear earphones that impede your hearing while crossing the street. Don’t walk on or near roadways while intoxicated, which could be extremely dangerous. It is important that pedestrians obey traffic signals, avoid jaywalking, and heed traffic and roadway conditions.

Often, pedestrian accidents occur because of driver error or negligence. Pedestrian accidents could occur because of driver intoxication, or, where a driver is distracted, speeding, or, is failing to obey traffics signs and signals.

If you or a loved one has been injured in a New Jersey pedestrian accident, consult with an experienced New Jersey personal injury lawyer at Blume Goldfaden. Our attorneys have the knowledge and training to thoroughly investigate the circumstances surrounding your accident, and, can protect your rights by holding negligent parties accountable.

On Tuesday, January 26, 2010, the U.S. Government announced a national ban of hand-held texting for drivers of large commercial trucks and buses. The new text messaging ban takes effect immediately, and those caught violating the ban will be forced to pay a fine of up to $2,750. While several U.S. companies enforce self-imposed bans against texting for their employees while driving on-the-job, the rash of distracted driving accidents continues to spread. The National Safety Council estimates that as many as 200,000 auto accidents on United States Highways are the result of texting while driving.

According to a reuters.com article, the new U.S. texting ban is expected to help lower the danger of distracted driving. Transportation Secretary Ray LaHood stated, “We want the drivers of big rigs and buses and those who share the road with them to be safe…This is an important safety step and we will be taking more to eliminate the threat of distracted driving.” Research conducted by trucking regulators has demonstrated that drivers take their eyes off the road for almost the entire time that it takes to send, and receive, a text message.

Almost two dozen U.S. states, including New Jersey, ban texting while driving any motor vehicle and the problem has become so widespread that Congress is addressing legislation to prohibit this form of negligent driving on a national scale. Handheld cell phone use is banned for all drivers in New Jersey where the distracted driving laws are all considered ‘primary enforcement’ statutes, which means that a police officer may issue a ticket to a driver for using a handheld cell phone while driving without committing any other traffic offense.

Auto accidents, especially those involving trucks, or, buses, may cause innocent passengers, and, drivers to suffer serious injury. When such incidents are brought about by distracted driving, injured individuals may be able to seek compensation for expenses associated with their injuries. For more information regarding a potential injury claim associated with a distracted driving accident, please contact the experienced New Jersey car accident attorneys at Blume Goldfaden at 973-635-5400 for a no-cost consultation.

Federal safety officials at the National Highway Traffic Safety Administration (NHTSA) have launched an investigation with regard to problems of engine stalling in Toyota Matrix and Toyota Corolla models. According to an article from bloomberg.com, the NHTSA document cited 26 complaints of the engines in these vehicles stalling suddenly. Some of the complaints said the stalling occurred when the drivers were on highways or passing through intersections.

The troubled automaker recently issued a massive auto product defect recall involving 4.2 million Toyota and Lexus vehicles. Those models had sudden acceleration problems, which were related to defective design of the accelerator pedal. Toyota also recently recalled 110,000 Tundra pickup trucks because of a rust problem that could cause the spare tire to fall out of its well, creating a hazard for other vehicles on the roadway.

Engine stalling, sudden acceleration, and, other auto product defects, are extremely hazardous, and, can result in motor vehicle accidents resulting in devastating injuries to occupants of vehicles. Those injured and their families may incur significant expenses related to medical/hospital treatment, rehabilitation and other therapies. In many cases, those injured and/or their family members may not be able to return to their jobs, or, be gainfully employed again.

Successful treatment of cancer is usually dependent upon early recognition, diagnosis, and treatment. According to a recent news report in Science Daily, a new miniature hand-held microscope may allow doctors to not only accurately diagnose tumors sooner, but also aid in their removal in instances where surgery is necessary.

Neurosurgeons are using the new miniature “confocal” microscope to view brain tumors in real time during exploratory procedures. Digital images of tumor and brain tissue can also be obtained by using the new microscope. Previously, surgeons had to take biopsies of tissue in order to identify tumors. However, these new microscopes distinguish cancer cells and the size and characteristics of the brain tumor without a biopsy.

While news of these advanced treatments is indeed promising and gives hope to cancer patients and their families, it is impossible to implement use of this groundbreaking technology if a patient’s symptoms are ignored, or, not timely investigated. Unfortunately, when a delay of diagnosis of cancer occurs, many patients suffer devastating consequences as a result, including a worsened prognosis, the need for more extensive, radical and/or invasive treatment, and, even death.

If you or a loved one have been misdiagnosed or have had a delay in the diagnosis of your malignancy, and, have suffered as a result, you may be able to bring a medical malpractice claim against the healthcare providers (doctors and hospitals) that failed to properly diagnose your disease.

Contact the New Jersey delayed diagnosis attorneys at Blume Goldfaden for a no-cost case evaluation. Our cancer misdiagnosis attorneys have the experience and expertise to evaluate your potential claim and determine whether delayed diagnosis or malpractice resulted in a worsening of your medical condition.

Safe driving practices are the best way to prevent automobile accidents. Ultimately, if every motorist on the road followed every traffic rule, the number of injuries and deaths that occur on our nation’s roads and highways each year would be greatly diminished. According to the Department of Motor Vehicles in New Jersey, traffic law mandates that the headlights on a vehicle must be illuminated from 30 minutes after sunset to 30 minutes before sunrise. Using your headlights in accordance with this regulation not only allows a motorist to clearly see the road ahead of him or herself, but also allows motorists to clearly see oncoming vehicles. Inclement weather, particularly when visibility is reduced to 500 feet or less, is another prerequisite for making sure that one’s headlights are on. In rainy weather, when visibility is limited by both the weather conditions and the use of windshield, headlight usage is vital.

Every year, thousands of motorists are injured because other motorists choose not to follow traffic laws. In the event that driver negligence causes an accident resulting in injury, our legal system allows for compensatory damages to be paid to the injured parties. In order to ensure that your rights to such compensation are protected, an experienced New Jersey auto accident attorney should be retained to assist those injured in motor vehicle accidents in pursuing their claims.
