In this product liability case, Ken Elwood represented a construction worker who was working on a mobile platform. The machine's controls
were defective in their design, which made it dangerous to operate.
The same controls which would make the platform go higher could
also be used to make it move forward. Our client was 20 feet
off the ground on the platform and attempted to raise it higher.
Instead of the platform rising, it lurched forward into a pothole
and caused our client to fall. The man suffered leg fractures,
a fractured skull, and a spinal fracture requiring surgery and
a spinal fusion. Mr. Elwood settled this case after mediation
for $885,000.
