Fall 2008 Kenneth Elwood represented a woman who fell on an ice covered sidewalk in front of a residence suffering a severely fractured ankle that required surgery and the placement of hardware. Under the law, residential homeowners can be immune from natural weather related claims. However, Ken investigated the weather records which proved that there was no precipitation for 1 week prior to the accident. In addition, the neighbors had noticed this homeowner leaving her front yard water hose on in the winter. Ken also worked with a meteorologist expert, who was able to opine that the more likely cause of the ice was the homeowner negligently leaving the hose running. Ken was able to settle this case for $270,000. |
