David Fried represented the estate and family of a woman in her late 40s. The woman and her 9 year old son, who while swimming at an Atlantic Ocean beach in Spring Lake, New Jersey, were caught in a rip tide. A lifeguard assisted the boy to safety. The boy told the lifeguard that his mother was still out in the ocean. The lifeguards did not act promptly to look for and bring the woman to safety. Ultimately, the lifeguards formed a chain out in the water and found the woman on the ocean floor. She died several days later. David Fried was successful in obtaining a $250K settlement in this difficult liability case where the deceased woman also did not have a significant history of earned wages.
