Zerres Settlement: $700,000.00 and $675,000.00 Spring/Summer 2009 Blume Goldfaden attorney, Michael Zerres, recently settled two medical malpractice cases involving Erb's Palsy injuries to newborn infants, which occurred when their mother's obstetricians failed to properly manage a shoulder dystocia presentation at delivery. The cases settled for $700,000.00 and $675,000.00, respectively. In both matters, the infant plaintiffs sustained a tearing injury of the brachial plexus nerves at the C5-C6 levels, requiring surgical repair. Despite operative intervention, the children were left with a moderate degree of residual impairment resulting in limited range of motion and use of the effected shoulder, upper arm, forearm and hand. |
