| Attorney - Michael Zerres Spring 2004 A 7-year-old Mississippi boy recently obtained a $575,000.00 settlement following mediation. The boy's mother was a gestational diabetic, which increased her risk for a shoulder dystocia at delivery. It was claimed that her obstetrician should have informed her of the option of a c-section delivery to avoid the risk of shoulder dystocia, but he failed to do so. The mother proceeded to vaginal delivery, where a shoulder dystocia was encountered. The doctor then applied excessive downward traction on the baby's head, tearing the child's brachial plexus and causing a permanent right Erb's Palsy injury. Michael Zerres attended the mediation with local Mississippi counsel and settled the matter for the family. |
