| Attorney: Michael B. Zerres Settlement: $1,800,000. Spring 2010 As a result of an injury suffered at birth, a 7 year old Paterson boy will receive a 1.8 million dollar settlement for his injuries. During birth a resident physician applied a vacuum extractor with excessive force while the attending physician applied fundal pressure, which is contraindicated in a vacuum or forceps delivery. As a result, injury to the brain occurred and the baby went into shock. CT Scan images of the brain documented cerebral edema, or swelling, of the subgaleal space, which was a result of the excessive force applied by the two physicians. The child also went on to suffer seizures, and, now requires special education and assistance with activities of daily living. The attending physician contributed to the settlement, as did the hospital, who employed the resident, and, who was exposed to an "apparent authority" claim for holding out the attending physician as a hospital employee.
