Jury Verdict Against Perth Amboy Hospital

Despite two reported indications of distress on a fetal monitor, the physician responsible for a woman's labor and delivery failed to arrive at the hospital for nearly two hours, even though he lived only 15 minutes from the hospital. When Dr. John Berger, employed by Raritan Bay Medical Center, finally arrived at the Hospital , he requested that another obstetrician examine his patient. An immediate Cesarean section performed, but the delay caused the baby to be born with mild cerebral palsy and mental retardation. John Blume tried this cases over a three week period in Middlesex County. The jury found the physician 80% negligent and a nurse, also employed by the hospital, 20% negligent.
