In October 15, 1987, a three and a half year old boy was irreversibly brain damaged when his pediatrician refused to allow paramedics to treat the little boy. The boy had been taken to Dr. Jeffrey B. Herman of the Sayerville Medical Clinic for treatment of cough and fever. While at Dr. Herman's office the child began having seizures.

When paramedics arrived, Dr. Herman refused to allow them to administer proper treatment and instructed them to leave. The doctor insisted on accompanying the child to the hospital and refused to allow the ambulance crew to take the boy's vital signs or to follow their suggestions, even though they were requested by the hospital via radio.
