Failure to Diagnose Fetal Distress and Timely Perform a C-Section Delivery - Settlement $2 Million

Attorney - John M. Blume & Carol Forte
Fall 2005

John Blume and Carol Forte worked together on a case involving a child who now has Cerebral Palsy.  The obstetrician failed to diagnose fetal distress during labor, and delayed in ordering a C-section delivery of the child.  As a result of this, the child was deprived of oxygen for a prolonged time and suffered severe brain damage.  The case was settled for the full amount of the $1 Million insurance policy of the obstetrician, plus an additional joint contribution of $1 Million from the obstetric nurse and the hospital.
