Carol represented a family who has a severely neurologically impaired child. At the time of the boy’s birth at Kimball Medical Center, the obstetrician failed to recognize that the fetal monitoring strips were showing fetal distress during the mother’s labor. He failed to perform a cesarean section delivery of the child which was indicated in light of the fetal distress, allowing the mother to continue labor which resulted in the ongoing deprivation of oxygen to the baby’s brain. This caused severe brain damage. The obstetrician and his group had a total of $2,000,000 worth of insurance coverage.
