Million Dollar Recovery - Death of Man Following Pinky Surgery |
| Attorney - Carol Forte Spring 2004 Carol Forte, a firm principle, represented the Estate of a man, in his mid 50's, who injured his pinky finger while at work. He was taken to a Newark hospital for treatment. An orthopedist decided that his finger needed to be operated on, and decided to do it that night. The anesthesiologist, who assisted with the surgery, testified that while he felt that the patient would be at risk for general anesthesia because of preexiting medical issues, and should have received a local anesthetic, nonetheless, gave the man general anesthesia anyway because he said, the patient was nervous. Problems began immediately after the patient was sedated and paralyzed, when the breathing tube could not be passed. Instead of taking the appropriate steps to get oxygen to the patient, the anesthesiologist persisted in his attempts to get the tube down the airway, causing trauma and swelling and making the situation worse. Finally an emergency tracheotomy was done, but the patient had been deprived of oxygen and was brain damaged. He died shortly thereafter. The case settled for 1.2 million dollars. |
