A construction worker unloading steel columns fell off the flatbed of a truck. He severely injured his neck and required multiple operations. He sued the owner of the truck. The defendant claimed the truck was in good condition when it was delivered to the job site, but Berkowitz claimed it had been dangerous for a long time. He hired a wood analysis specialist, who established that the defects in the flatbed had existed for quite some time, and that the owner should have been aware of them and had them repaired.
