The plaintiff, a 60 year-old construction worker was walking
on scaffolding at job site. The scaffolding had been erected
by the man's employer. However, the scaffolding was inadequately
supported from below. The project manager on site was in charge
of safety. Through OSHA records, Blume Goldfaden attorney, Jeff
Zenna, was able to establish that the safety manager was on
notice of the dangerous condition as there had been similar
violations in the past. In addition, evidence was discovered
indicating another subcontractor was injured in a similar way
prior to the plaintiff's accident. As a result of the fall,
the man suffered non-displaced pelvic fractures of his hip,
which did not require surgery, but causes chronic pain.
