Blume Goldfaden Partner, Dennis M. Donnelly, settled this wrongful birth case where an Obstetrician only gave genetic counseling by telephone after an ultrasound report noted the absence of Down Syndrome markers, but still noted some risk of abnormalities. A radiologist also failed to specifically describe in his ultrasound report, a cyst in the midbrain of the fetus. The shortcomings in communication with the parents, and the failure to properly report the brain cyst, deprived the parents of the choice to undergo further testing and elect to terminate the pregnancy.
