Fall 2010 John Molinari represented a 23 year old motorcyclist that was involved in an accident with an uninsured vehicle in Irvington, New Jersey. The driver of the uninsured vehicle was never able to be located. A lawsuit was filed against the County of Essex for improper lane and line markings in the roadway. John established, through expert opinion, that the painting of the line markings deviated from the approved plan, and that the improper markings caused the other driver to enter our client’s lane of travel. The man sustained leg, knee and arm fractures, and during his hospitalization developed sepsis and died. The defense contended that the negligence of the uninsured driver was the cause of the accident. |
